JUST IN: Besigye and Lutaale Apply for Bail at High Court

Rtd. Col. Dr. Kizza Besigye and Hajj Obeid Lutaale have applied for bail at the High Court of Uganda. The two are facing charges of treason and misprision following their arrest in February 2025. They contend that their cases are bailable, as they are law abiding citizens with strong ties to their communities.

The application, under Criminal Application No. 0113 of 2025, will be heard in the High Court’s Criminal Division. Besigye and Lutaale were initially charged at the Chief Magistrates Court of Nakawa and remanded in custody. Since the charges are bailable only by the High Court, their legal team is seeking the court’s permission to grant them bail.

In their application, the two men point out their status as responsible citizens with permanent places of residence in Uganda. Besigye lives in Kasangati, Wakiso District, while Lutaale resides in Rukungiri and Makindye in Wakiso.

They stress that they have no intention of fleeing or interfering with ongoing investigations.

The applicants assure the court that they will cooperate fully with the legal process and attend all required hearings. Their affidavits, along with those of their sureties, are being submitted to support their application, demonstrating their commitment to the law.

Besigye and Lutaale’s legal team also points to their history of respecting legal processes and complying with bail conditions in the past. They argue that the applicants do not pose a threat to public order or safety and should therefore be granted bail while awaiting trial.

As the case progresses, it remains to be seen how the court will rule on their application. However, Besigye and Lutaale’s legal team remains confident that they will be released from remand custody based on their strong legal standing and commitment to the process.
